I have been (unofficially) warned that DJing from my PC is ILLEGAL in Canada, and that I should expect my EQUIPMENT to be SEIZED by the A.V.L.A. (Audio Visual Licensing Agency - http://www.avla.ca/ ). Apparently copying music to the hard drive is the issue (piracy).
Could Virtual DJ efficently opperate as a DVD Player control device? (external USB or ?) This would resolve these issues.
I was also told not even to mention the fact that the software has built in broadcast ability or my entire music collection will be seized.
The sources are ABSOLUTELY reliable. I will not identify them because i do not want to admit that i was warned.
My understanding is that the CDJA Canadian Disk Jockey Association ( http://www.cdja.org/ ) does not have the legal resources to fight the AVLA.
This is not a new issue in Canada.
PS: I am a single operator who has the original copies (DVD & CD) in a case on each show. I am not downloading or steeling my music. My music collection is specifically licensed for professional DJing.

Easy fix just become a member so you can play your music.
Mensajes Sat 08 Oct 05 @ 4:07 pm
Become a member of who or what? There is nothing to join. Or please tell what you know that i don't. Everything PartyFrog does is about "doing it right". AVLA forbids DJing from a computer. FUCK THEM!

If your music was purchased from a record store, or you own legally you don't need a license from AVLA. Read the first lines: http://www.avla.ca/pdf/broch%20electr%20sample.pdf
You could pay an anual fee ($250) to use music in your harddisk.
Application for use Music in a Hard disk: http://www.avla.ca/licenceinfo/djlicences/comphd/chdla.html
Check with other associations of DJ, because if you belong to one of them, you do not have to pay anything to AVLA:

Like I said before a AVLA licence. Don't you see they want to extort money from you since a jealous dj snitched you out most likely. Idoesn't look like na bad deal though no more worring about being illeagal.

You people in Canada need to fix your problems. It seems They want to collect on your music twice or even three times. In the U.S. You can make a copy of your Cd's and use it for you Dj bussiness. The bar that you play at or other establishment pays the fees. If the have a jukebox they have the licence or they soon they will when someone finds out and makes them pay. If you Dj for a wedding or private party a license is not needed. If you broadcast thats another story. A license is needed for that. Over the internet I am not sure of. They probably have some kind of license for that. It would be nice if they had a affordable digital Dj license so we dont have to worry .But they tend to get out of hand when charging for such services. They are greedy and that needs to be regulated. It's not so much of a licence but the amount of money they want to charge. They alway inflate the price which promotes piracy from everyone. It does not solve the problem they started in the first place. Charge a fair price to give us a clear mind and help plug the hole created by greed.

Hi Troy,
In regards to the below questions, hopefully the following answers will be satisfactory:
(a) PODDS will be making video available in the future but we don't have a specific time frame as of yet.
(b) The Promo Only Digital Download Service IS the only LEGAL source for downloaded music for the purpose of commercial use in Canada. Napster is not for commercial use and since their songs are not approved for commercial use by the AVLA then it is not legal in Canada for commercial end users to use music downloaded from Napster (or Itunes or any other online music service). This is true even if a the person has purchased an AVLA hard drive license.
(c) Sadly with all the red tape and "grey areas" still left in the industry vs. licensing in Canada, it may take a long time for the licensing to catch up to the technology available today. Fortunately though, companies like Promo Only are willing to fight these battles with the AVLA on behalf of the commercial users out there to make this technology available. While it may be happening in what feels like baby steps now, know that as long as new ideas and technology are being created we will be doing everything we can to make it available for commercial users in Canada.
If you have any other questions or concerns please feel free to contact me.

move to the US, problem solved
just a quick question tho, what the merry fuck is the point of the $250 (thats not too far from 250US rite?)harddrive licence if you cant play the songs you have on it? is it just a flat fee to let you leave the CDs at home and save your back?
if you own the orignial CDs it seems ridiculous they can get some money from you just for the way you play them?????!?!!??!???

Hey Troy when we've had investigators come into the club they only wanted to see the physical cd's
He didn't seem to give a shit about the fact that they were transfered to my harddrive.
I agree , the laws in Canada need to be streamlined to reflect changing times.

(a) re: $250 - That is how I feel. If I pay, then AVLA, go away... I and I have no issues with paying!
(b) I have had an "inspector" come to my club too. Or so he claimed. I ask for a badge, he decilned, but persisted. I offered to have him physically removed (with a really big grin on my face!). Was he AVLA? -Who knows. Dressed like trailer trash... not very pro who (or what) ever he was.
No badge, No touch, No Exception.
Why are Canadian DJs being harassed about BS, when this province (country and continent) are on the verge of civil war? What a screwed up system. ...when farmers have to take up arms to protect themselves from BOTH the police and Native Warriors (and their visable Palestinean alies)... And then simple DJ's lose all for stepping on Corporate toes. HAIL CLEAR CHANNEL! HAIL TO THE RAT! Maybe I should just do something safe; like running guns.
Our company had to relocate form Haldiamond / Norfolk countys (this summer) due to the violence, and the police doing nothing but stirring the pot. "Just let 'em kill each other, it'll make our job easier" -OPP
Oh ya, I'm looking to (eventually) move to China, not the US. I am going to try & find peace, happiness and real freedom. Perhaps the communists have it figured out... No AVLA there, hell no intelectual property rights at all!

Does this cover video? Copyright vs. Trademark... I was told not to play home DVDs. How do we define "you own legally"?
Mensajes Thu 28 Sep 06 @ 4:13 am
Hey Troy....I think when the loony Libs were in power one of the things they pushed through, thanks to Mz Copps was a tax on ALL media such as DVDs, tapes, Cd's, video tapes and what ever else can be replayed or recorded on. This was to insure that artists were paid for what they did. All an artist has to do is apply for his/her portion of the fund. How they figure out what they are supposed to get is beyond me. This was done because of the peer to peer file sharing programs that are out there and owners of the media could make copies and be able to do so legally.. So if you own a CD and transfer it to your hard drive, then you are already legit due to this tax. Also the bar that you play at pays a license fee so that anyone coming in to spin can do so legally. Check to make sure the bar has paid this license. If you own the Cd's and are playing the tunes from your hard drive then you are 100% covered. Also if some trailer trash dude asked me to put up or shut down I would not have been as polite as you were. No I.D., no badge, just a mouth does not cut it with me. I do not think the powers that be want to waste their time going after Disc Jockeys who are trying to make a living while at the same time promoting a multitude of artists in one night. They want to go after the folks who are producing copy-written stuff and selling it with out paying their dues. If you already have the requiered permits in place then don't worry. It's a tempest in a tea pot my friend. Just go to the club, play your music, keep the people happy and above all.........
Keep the beat sweet.

I think raw bear got it right.
As a side note the guy that came into the bar was well dressed , provided P.I. ID, and even left his wallet in the dj booth with me when I told him I wanted a Business card to verify with AVLA that they sent him. Although seeing as he didn't give me a hard time I never bothered to call and check up on him.
Shoulda, coulda, woulda.

In my opinion we should look at the AVLA as basically an additional tax to perform with music. In most cases as long as you can produce an AVLA license number they will leave you alone. If you are performing publicly anywhere there are 2 licences required in Canada; SOCAN by the facility you are performing at and an AVLA license by the DJ or Karaoke VJ etc. If either of these elements are missing you are technically performing illegally. Granted many people do this on a constant basis, but, the AVLA doesn't really have the resources to police everywhere. So, they rely on investigators and "blitzes" in particular cities occasionally as scare tacticts to get people to sign up.
The AVLA has no real power to do anything on their own. If you push it and don't obtain a license they can return with RCMP to shut things down and following this possible legal action based on copyright infringement.
If you want to be "safe" have an AVLA license number and they will likley leave you alone.
Cheers!

I hear that there is an illegal DJ, copying music out on the rez in Caledonia! I wonder if we could get the AVLA to investigate that? I wonder if they would go back with the RCMP (to the rez)?
I think 'not', actually, I know 'not'!

PS - I too fight the fight against 'copy jockys'. They do hurt my business ('copy jockys'). And, in fairness, my latest contract was, in part, based on the club owner wanting a 'legal' DJ to run the show. There is reasonable suggestion that AVLA does not cover Karaoke. -(a) too many sources and producers to get them all together. (b) copywright (music) vs trademark (images).
How does the AVLA make its claim anyway, sure they represent the big labels, but how can they stop me (us) from downloading inde tracks -especially if the band wants their music promoted? I think many industry people hide behind generalizations and fear. -kinda like the OPP.

I will admit, that if I was professionally and politely approached (buy the AVLA), I might just roll out the red carpet. ...and even show off my rig a bit. She is sweet.
What really gets under my skin is that I feel like I have to hide from this organization, when, in reality they may be working towards my companies best interests. -I have had several (heated) discussions with a karaoke (disk) producer about these issues. I think that we have both found middle ground.
And yes, I just downloaded the CRDMO application for the systems in the club that I am opening... And yes, I am going to pass this on the the customer as an admin fee. Hell, I probably will add $50 for myself...

You know....I just had a brain burp. Maybe it's time for the VDJ and Atomixmp3 people in Canada to form their own union. There is certainly enough of us in Ontario to form up an organization of some sort to help fight this crap. I have a store front that we could use as a home base and as I am there all day, I could even take calls about the injustice of things and put it forth to the membership. I do not have a clue on what dues should be, but I think if we get enough interest we could sign people up for about 50 bucks a year. Get 1,000 due paying members and we would even have enough to fight them in court. Of course any one who is a member could hold office. Anyone holding office would do so by election and would be on a volunteer basis, no pay. If we have enough dedicated people who are in this profession working at it, we could end up being a real thorn in someones butt and get some justice.
By getting the justice we so richly deserve we would .....

I'm out in Alberta here, there's only about 4-5 users that I know in edmonton. Myself, another Guy who's day job is a martin lighting rep, A Mobile DJ company, and 2 more that dj in clubs, oh yeah one guy who works a strip club with the HDC MKII. So probably not much interest out here. As far as I know I'm the only club DJ to have the AVLA come through this year, I was asking a couple of others they hadn't had anyone come through as of yet.
